These “Program Rules” describe how you may earn SKYPASS Miles in the reward program (the “Program”) that is part of one of the SKYPASS Visa credit card accounts (each, an “Account”) issued by U.S. Bank, listed below. Miles will be deposited into Cardmember’s Korean Air SKYPASS account and may be redeemed for award flights and upgrades on Korean Air and SkyTeam partners. In addition to earning Miles, Cardmembers may also earn other benefits, as described in these Program Rules.

In addition to other terms defined in these Program Rules, as used in these Program Rules:

• “Card” means the credit card issued for your Account.
• “Cardmember” means each individual who holds a Card.
• “Cardmember Agreement” means the agreement between you and U.S. Bank related to the Account.
• “Korean Air” means Korean Air Lines Co., Ltd.
• “Miles” means SKYPASS miles that you earn in the Program using your Card.
• “Korean Air SKYPASS program” means the SKYPASS frequent flyer program owned and managed by Korean Air.
• “U.S. Bank”, “we”, “us” and “our” means U.S. Bank National Association.

Capitalized terms that are not defined in these Program Rules are defined in the Cardmember Agreement.

To participate in the Program, your Account must be open and in good standing (not past due or overlimit) under the terms of your Cardmember Agreement. For consumer Accounts, and except as described in these Program Rules, all Net Purchases (defined below) made by Cardmembers will be awarded Miles, and Miles will be credited to the primary Cardmember’s Korean Air SKYPASS program account. For business Accounts, and except as described in these Program Rules, all Net Purchases will earn Miles, and Miles will be credited to each primary Cardmember’s Korean Air SKYPASS Program account. Redemption of Miles is subject to the terms of the Korean Air SKYPASS program. We may alter, change, or terminate the Program at any time with or without notice to you. In addition, we may close the Account and Program if you violate any of these terms and conditions or the terms of their Cardmember Agreement. Determination and payment of tax liability is the sole responsibility of the Cardmember. The Program is void where prohibited by federal, state, or local law.

Participation in the Korean Air SKYPASS program is subject to the terms and conditions in the Korean Air SKYPASS program and SKYPASS Membership Guide. Korean Air is solely responsible for the redemption and fulfillment of Miles. Korean Air may change the Korean Air SKYPASS program rules, program partners, regulations, benefits, conditions of participation or mileage levels, in whole or in part, at any time with or without notice, even though changes may affect the value of mileage already accumulated. Redemption of Miles for flights and upgrades is subject to seat availability. U.S. Bank has no obligation to award Miles in the Korean Air SKYPASS program or to provide or arrange for any service relating to travel or the use of Miles. Our sole obligation with regard to the Korean Air SKYPASS Program is to ask that Korean Air award Miles.

The Korean Air SKYPASS program number on the Account must belong to the primary Cardmember for consumer Accounts. For small business Accounts, each Cardmember will have his/her own Korean Air SKYPASS program number. A change to a Korean Air SKYPASS program number must be made with Korean Air. In order to earn Miles, the Korean Air SKYPASS program number must also match the number on your Account. Please ensure that any Korean Air SKYPASS program number change is accurately reflected on your Account.

SKYPASS VISA CONSUMER CREDIT CARD ACCOUNTS

SKYPASS SkyBlue Visa® Card

U.S. Bank will request that Korean Air award Miles earned by using your Account as follows:

(i) 2 Miles (1 “Standard Purchase Mile” and 1 “Double Miles”) for every $1 spent in eligible Net Purchases on rideshare or streaming subscription services; and
(ii) 1 Mile for each $1 spent on all other Net Purchases.

SKYPASS Visa Signature® Card

U.S. Bank will request that Korean Air award Miles earned by using your Account as follows:

(i) 2 Miles (1 “Standard Purchase Mile” and 1 “Double Miles”) for every $1 spent in Net Purchases on qualified Korean Air ticket purchases. Qualified Korean Air ticket purchases include such purchases where Korean Air is the merchant of record on your statement, such as tickets purchased directly from Korean Air ticket agents or koreanair.com; and
(ii) 2 Miles (1 “Standard Purchase Mile” and 1 “Double Miles”) for every $1 spent on eligible Net Purchases at hotels, restaurants, fast-food restaurants or bars; and
(iii) 1 Mile for every $1 spent on all other eligible Net Purchases.

SKYPASS Select Visa Signature® Card

U.S. Bank will request that Korean Air award Miles earned by using your Account as follows:

(i) 3 Miles (1 “Standard Purchase Mile”, 1 “Double Miles”, and 1 “Triple Miles”) for every $1 spent on eligible Net Purchases on qualified Korean Air ticket purchases. Qualified Korean Air ticket purchases include such purchases where Korean Air is the merchant of record on your statement, such as tickets purchased directly from Korean Air ticket agents or koreanair.com; and
(ii) 2 Miles (1 “Standard Purchase Mile” and 1 “Double Miles”) for every $1 spent on eligible Net Purchases at airlines, hotels, car rentals, restaurants, fast-food restaurants, or bars; and
(iii) 1 Mile for every $1 spent on all other eligible Net Purchases.

SKYPASS Visa® Card

SKYPASS Visa® Secured Card

U.S. Bank will request Korean Air award Miles earned by using your Account as follows:

(i) 1 Mile for each dollar of Net Purchases.

SKYPASS VISA BUSINESS CREDIT CARD ACCOUNTS

SKYPASS Visa Signature® Business Card

U.S. Bank will request that Korean Air award Miles earned by using your Account as follows:

(i) 2 Miles (1 “Standard Purchase Mile” and 1 “Double Miles”) for every $1 spent on eligible Net Purchases on qualified Korean Air ticket purchases. Qualified Korean Air ticket purchases include such purchases where Korean Air is the merchant of record on your statement, such as tickets purchased directly from Korean Air ticket agents or koreanair.com; and
(ii) 2 Miles (1 “Standard Purchase Mile” and 1 “Double Miles”) for every $1 spent on eligible Net at gas stations, electric vehicle charging stations, office supply stores, cell phone service providers, restaurants, fast-food restaurants, or bars; and
(iii) 1 Mile for every $1 spent on all other eligible Net Purchases.

There is no maximum number of Miles that may accumulate in a calendar year on any of the SKYPASS Visa cards.

Your Account must be used to make the Purchases in order to be eligible to earn Miles (including Double Miles and Triple Miles). The single Mile per dollar spent for Net Purchases will appear on your Account statement as Standard Purchase Miles. The second Mile, or Double Miles, will appear as Double Miles earned on the Account statement. The third Mile, or Triple Miles, will appear as Triple Miles on the Account Statement. Miles will not be requested if your Account is past due or overlimit at the close of your Account billing period.

Each merchant’s business is identified by a category code established by Visa. We do not determine the category codes applied to merchants’ businesses and reserve the right to determine which purchases qualify for additional Miles. Purchases made through a third-party payment account or on an online marketplace (with multiple retailers) will not earn additional Miles.

"Net Purchases" are Purchases minus credits and returns. Net Purchases for a statement period are determined by totaling all new Purchases charged to the Account during the billing cycle, then subtracting credits posted to the Account during the billing cycle for returned Purchases and/or adjustments. If credits during a statement period exceed Purchases, the credit balance will be carried over to the following billing cycles and offset against future Purchases charged to the Account for purposes of awarding Miles. We may round Net Purchases up or down to a whole dollar amount for purposes of determining and awarding Miles. We reserve the right to adjust or reverse the number of Miles that were awarded for unauthorized. We reserve the right to adjust the amount of Miles that we request from Korean Air to award for Purchases or to stop requesting miles for Purchases on the Account, upon notice to you. All Miles postings to the Korean Air SKYPASS program are at the discretion of Korean Air. For posting discrepancies related to Miles posted in your Korean Air SKYPASS program account, please contact Korean Air Service Center at 1-800-438-5000. We reserve the right to amend or cancel this Program or change the rewards and other benefits at any time with or without notice to you.

Not all transactions are considered to be Purchases and eligible to earn Miles, such as transactions posting as Convenience Checks; Balance Transfers; Advances (including ATM withdrawals, wire transfers, traveler's checks, money orders, foreign cash transactions, betting transactions, and lottery tickets); interest charges and fees; credit insurance premiums; and transactions to (i) fund certain prepaid card products, (ii) buy currency from the U.S. Mint, or (iii) buy cash convertible items. No retroactive credits will be given for prior Purchases.

Miles from different Accounts may be combined into one Korean Air SKYPASS program account. Miles cannot be used in conjunction with other frequency or reward programs.

Bonus/Promotional Offers. You may be offered the opportunity to earn bonus Miles at any time after you open this Account. If you are offered a promotion, you must follow all the requirements outlined in your offer materials (such as spend amount and timing requirements). In most cases, you should allow 1-2 statement billing cycles for bonus Miles to appear on your Account statement.

This Account is intended to be used for the purchase of various products and services for personal, family, household and business purposes, and we have the right to adjust the number of Miles that were awarded or terminate the Account if we determine that Purchases or transactions were outside of such use, including, without limitation, excessive or patterned purchases of cash equivalent instruments, such as gift cards, rewards cards, and other prepaid cards.

Additional benefits may be available based on Account type, as described below.

SKYPASS Visa Signature, SKYPAYSS Visa Signature Business and SKYPASS Select Visa Signature may be eligible to receive 5% discount coupon(s) in the Cardmember’s SKYPASS account upon SKYPASS Visa Signature/Visa Signature Business/Select Visa Signature Card account opening and each anniversary year. SKYPASS Visa Signature and SKYPASS Visa Signature Business primary Cardmembers (which does not include employee Cardmembers) will receive 1 ticket discount and SKYPASS Select Visa Signature primary Cardmembers will receive 2 ticket discounts. Discount applies to qualified Korean Air ticket purchases only on koreanair.com made within 1 year from the date the coupon(s) is/are deposited into Cardmember's SKYPASS account. Account anniversary year means the year beginning with your Account open date through anniversary of your Account open date, and each 12 months thereafter. Please allow 10 business days from new Account opening and up to 1-2 statement billing cycles for anniversary Accounts, for the coupons to be deposited into your Korean Air SKYPASS program account.

Coupon applies to Prestige Class and Economy Class base fares and excludes taxes, fees and other ancillary surcharges. Certain destination and fare types may not be eligible for discount offers. Coupon is valid for flights operated and marketed by Korean Air, excluding codeshare flights, from Korean Air North American gateways to the following destinations: Korea, China, Japan, Southeast Asia, and Southwest Asia. Coupon is available for flight reservation for up to two travelers and may be used by the primary Cardmember and 1 companion on the same reservation record. If a reservation includes more than two travelers, the primary Cardmember and one companion must be moved to a separate reservation to utilize the coupon. Discount will be canceled and full fare will be charged if any changes are made after the ticket has been issued and reissue penalty and other fees may apply. Discount may not be applied to award tickets, upgrade awards, tickets which include other airline flights, or tickets that have already been issued. Coupon is non-transferrable, non-refundable and non-endorsable and can only be used once. Use of each discount coupon is subject to all koreanair.com purchase rules and regulations. This discount ticket offer cannot be combined with any other offer. Unused discount coupon cannot be rolled over.

The Account must be open and in good standing at time the discount is applied. Your SKYPASS Visa Signature, SKYPASS Select Visa Signature Card, or SKYPASS Visa Signature Business must be used to make the ticket purchase in order to use the ticket coupon. Cardmembers must pay an annual fee on time to be eligible for the ticket discount.

Each year, the primary Cardmember with a SKYPASS Visa Signature, SKYPASS Select Visa Signature, or SKYPASS Visa Signature Business Account will be issued 2 complimentary Korean Air Lounge vouchers after Account opening and each anniversary date after the annual fee is paid on time. These vouchers are valid for 1 year from the date of issue. Please allow 10 business days from new Account opening and up to 1-2 statement billing cycles for anniversary Accounts, for the vouchers to be deposited into your Korean Air SKYPASS program account.

The access is available on Korean Air owned airport lounges in the USA (Los Angeles, New York, Honolulu) and Korean Air Prestige Lounge in Incheon, Korea only. Lounge voucher is valid for 1 person, 1 time use only and must be redeemed upon entering a Korean Air Lounge or you must provide your SKYPASS number. The primary cardmember can bring 1 accompanying passenger flying on a same flight to access the lounge after redeeming 1 additional voucher. To access the lounge after check-in or en route to the final destination, proceed directly to the lounge and provide your Korean Air SKYPASS program number. The vouchers are valid in conjunction with Korean Air tickets on Korean Air operated flights and cannot be used with tickets issued by other airlines. Lounge access is subject to space availability.

Offer is only eligible for SKYPASS Select Visa Signature Cardmembers. Please allow 10 business days from new Account opening and up to 1-2 billing cycles after Account anniversary date for delivery of In-flight Duty-free Coupons. Coupons are provided with Account opening package for new Accounts and are included with Account statement after annual fee is paid on time. Coupons may only be redeemed when purchasing duty free item onboard a Korean Air flight and may not be used or redeemed on online orders or in airports. Coupons are valid until expiration date. Coupons are non-transferable and have no cash value, and any unused portion of a coupon will not be refunded in cash or credit or any other manner. Must use SKYPASS Select Visa Signature Card for purchases that exceed coupon dollar value. Each coupon may be redeemed for purchase of $50 and over. Two coupons may be redeemed at once for purchase of $100 and over. Korean Air and U.S. Bank are not responsible for lost, stolen or damaged coupons. Coupons will not be replaced. Coupon cannot be combined with any other offers.

Offer is only eligible for SKYPASS Select Visa Signature Accounts. Automatic statement credit(s) totaling up to $200 will be applied to your Account when a SKYPASS Select Visa Signature Card is used for Net Purchases made directly from airlines, hotels, or car rental companies. Credit(s) apply to eligible Net Purchases that post to your Account each anniversary year. Account anniversary year means the year beginning with your account open date through anniversary of your account open date, and each 12 months thereafter. The date that a transaction is made may not be the same date that a transaction posts to your Account, and we cannot control when a merchant submits a transaction to be posted to your Account. Only one total credit amount of up to $200 per Cardmember year per Account, regardless of which Card(s) was/were used for the transaction(s). If eligible Purchase is greater than $200, credit will be limited to $200. U.S. Bank cannot control how merchants choose to classify their business or transactions and reserves the right to determine which Purchases will qualify. We reserve the right to adjust or reverse any portion or all of any travel credit for unauthorized purchases or transaction credits.

Current or former SKYPASS SkyBlue Visa, SKYPASS Visa Signature, SKYPASS Select Visa Signature, and SKYPASS Visa Signature Business Cardmembers are ineligible to receive an enrollment bonus for the same product if they have received a new Account bonus for that product within the preceding 5 years.

In addition to other disclaimers set forth in these Program Rules, U.S. Bank makes no guarantees, warranties or representations of any kind, expressed or implied, with respect to the goods or services offered by Korean Air or any participating merchant; and shall not be liable for any loss, expense, accident, injury or inconvenience that may arise in the connection with the use of such rewards; or as a result of any defect in or failure of such rewards. Third party vendors and U.S. Bank specifically disclaim any defect in or failure of such rewards. Third party vendors and
U.S. Bank specifically disclaim any implied warranties of merchantability or fitness for a particular purpose.

To the fullest extent permitted under applicable law, in no event shall U.S. Bank and its third party vendors be liable for any special, indirect, incidental, punitive or consequential damages suffered in any connection with the Program howsoever caused and regardless of the form of cause of action, demand or claim, whether based on contract or tort, including negligence, and even if such damages are foreseeable or any of the foregoing persons has been advised of the possibility of such damages.

Korean Air is not a party to this Agreement and has no authority regarding the Account, including with respect to any extension of credit on the Account. We are solely responsible for all credit extended on the Account. Korean Air is not a creditor or owner of the Account. You authorize us to share information about you and your Account with Korean Air.
